These terms cover what a booking includes, what happens if the weather turns, and what each of us is responsible for on the day.
Agreement
These terms apply to bookings made with Make My Beach Day and to your use of this website. Booking a setup means you accept them. If anything here is unclear, ask us before booking rather than after.
What a booking includes
Every setup includes delivery, setup and cleanup, along with beach chairs, shade, towels, a side table, a cooler packed with ice and water, and a speaker. Exact contents scale with the package and group size agreed at booking.
We set up before your arrival window opens and remove everything after your block ends. You are not responsible for assembling or packing down any of our equipment.
Booking, changes and cancellation
Confirming a booking
A request is not a confirmed booking until we have confirmed the date, location and package with you in writing.
Changes
Tell us as early as you can if the date, time, group size or location needs to change. We will accommodate changes where availability allows.
Cancellation
Cancellation terms are set out in your booking confirmation. Ask before booking if you need to know them in advance.
Weather
Southwest Florida weather is variable, and an unsettled afternoon frequently clears by evening. We stay in contact on the day rather than cancelling on a morning forecast.
Where conditions genuinely make a setup unsafe or unworkable, we will contact you to reschedule or discuss options. We do not put equipment or people on a beach in unsafe conditions.
Your responsibilities on the day
- Supervise your own group, including children, at all times. Beaches are unsupervised public spaces and there is no lifeguard provision as part of our service.
- Follow all applicable beach rules, including restrictions on alcohol and glass on City of Naples property.
- Do not move our equipment to another location or leave it unattended for long periods.
- Tell us promptly if anything is damaged or unsafe.
Equipment and damage
All equipment remains our property throughout your booking. Ordinary wear is expected and is not charged for. You are responsible for loss or damage caused by misuse, negligence or leaving equipment unattended.
Beach access and local rules
We set up on public beaches and do not control access, conditions, crowding or any action taken by a public authority. Where a rule or an official instruction prevents or ends a setup, we will work with you on the alternatives available.
Sea turtle nesting season, roughly May through October, restricts what may be left on the beach overnight and restricts lighting along the shoreline. Removal is included in every booking, so compliance on that point is handled by us.
Photography
We may photograph our own setups for our portfolio. We do not photograph guests without asking, and we will not use an image identifying you without your permission. Tell us at booking if you would prefer we take no photographs at all and we will not.
Limitation of liability
We provide our service with reasonable care and skill. To the fullest extent permitted by law, we are not liable for indirect or consequential losses, or for loss arising from circumstances outside our reasonable control, including weather, public authority action or beach closures.
Nothing in these terms limits any liability that cannot be limited by law.
